The suspended Assin Central NDC Secretary has threatened a legal action against the party if his suspension is not reversed within three days.

The suspended Assin Central Secretary of the National Democratic Congress (NDC) in the Central Region, Sadique Broni Yeboah, has threatened to take a legal action against the party if his suspension is not rescinded within three days.
In a letter directed to the party, lawyers of Mr. Yeboah contended that his suspension is against the principles of natural justice and fair hearing.
They argued that the party should rescind its decision and give him a fair hearing as their conduct violates the party’s articles 48 and 49.
According to the statement, “this is a clear contravention of due process envisaged under Articles 48 and 49 of the party’s Constitution and same infringes on the principles of natural justice to wit: audi alteram partem (hear both sides). To this extent, your decision is a complete nullity and void ab initio.”
The statement further noted that Mr. Yeboah is a loyal member of the party and if there’s any complaint against him, it lies with the Regional Executives to take a disciplinary action as he is a constituency officer of the Central Region.

They disagree with the decision taken by the Functional Executive Committee (FEC) of the party.
“The only exception to this is where NEC has referred the matter to the National Disciplinary Committee pursuant to Article 48 (6) of the party’s constitution.
“Our client informs us and as same is evidenced in your letter referenced supra that it is FEC and not NEC that has taken the decision to suspend him and refer the matter to the National Disciplinary Committee in clear contravention of the party’s Constitution,” the letter added.
On the back of this and other premises, the NDC member has given the party three days to rescind the decision or face legal action.
“We have the instructions of our client to demand from you the withdrawal of his suspension forthwith within 3 days and give him a fair hearing if you find it meet so to do.”
“Be informed that we have received strict and unqualified instructions from our client to take legal action against you in the event that you default in that regard,” the letter added.
The suspension came after a high-stakes meeting with the party’s national executives, the Functional Executive Committee (FEC), and Assin Central executives.

The meeting focused on the withdrawal of Nurein Shiabu Migyimah from his position as the party’s Assin Central parliamentary candidate (PC) due to allegations of immoral behaviour and anti-party activities.
Mr Mijimah’s suspension followed an investigation by the NDC’s Central Regional Functional Executive Committee into complaints against him, including accusations of impregnating the wife of the party’s Assin Central General Secretary
