Minister of Local Government and Decentralisation, Martin Kwaku Adjei-Mensah Korsah has assured that the Ministry would vigorously pursue the protection of all lands belonging to the Department and ensure that no developer or individual encroaches on the said lands, except for purposes for which they were acquired by the Government of Ghana.

He said this in Parliament on Thursday, July 4 while answering a question posed by Mr. Samuel Okudzeto Ablakwa, North Tongu lawmaker.

Mr Ablakwa had asked, “what the Ministry is doing to protect land belonging to the Department of Parks and Gardens in Accra and other parts of Ghana considering recent claims by some private developers of securing the title of Parks and Gardens claims particularly in Cantonments?”

In answer, the Minister said “Currently, as a Minister, I am still pursuing the matter and engaging all stakeholders to protect and secure titles of those that do not have or cannot be traced at Lands Commission.”

On the particular case of the Department of Parks and Garden’s lands in Cantonments, he said the recent claimant to the portion of the land indicated that he acquired title to the land in contention but could not produce any documentation after taking the matter to court.

The court subsequently dismissed the case and requested the Plaintiff to re-enter the case with proper documentation. Our checks however revealed that the claimant did not have any valid documentation to the land, he added.

“I wish to state that the land in question has a valid Certificate of Allocation dated 2nd October, 1952 to the Department of Parks and Gardens.

Regarding the Department’s land in Wa for instance, I wish to confirm that the Certificate of Allocation dated 27th November 1975 has been retrieved from the Lands Commission.

“In this regard, the Ministry has served notice to reclaim the encroached lands of the Department in the Upper West Region and other areas.

“The Land Use and Spatial Planning Authority (LUSPA) had in 2022, cautioned the general public to stay away from the use of the land for any private development purposes. Pursuant to the Land use and Spatial Planning Act, 2016 (Act 925) and its Regulations as well as Local Governance Act, 2016 (936), green belts, gardens and parks usage cannot be altered except through Parliament. In this regard, the Ministry is working closely with LUSPA to ensure that all developers and citizenry adhere to the planning and development permitting processes under the purview of the Metropolitan, Municipal and District Assemblies.

“Mr. Speaker, I wish to assure you that the Ministry would vigorously pursue the protection of all lands belonging to the Department and ensure that no developer or individual encroaches on the said lands, except for purposes for which they were acquired by the Government of Ghana.”
